Introduction

Welcome to HA Goods ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our transport and logistics services. By engaging our services, you agree to comply with and be bound by these Terms. If you disagree with any part of these terms, please do not use our services.

HA Goods is a transport and logistics company operating in Pakistan, providing comprehensive transportation solutions including heavy machinery transport, container shipping, bulk cargo transport, express delivery, warehousing, and special cargo handling.

1. Service Agreement

1.1 Service Provision

HA Goods agrees to provide transport and logistics services as specified in individual service agreements, quotations, or contracts ("Service Agreement"). Each shipment constitutes a separate contract governed by these Terms and the specific Service Agreement.

1.2 Quotations

All quotations are valid for 30 days from the date of issue unless otherwise specified. Quotations are based on information provided by the customer and may be subject to change if actual cargo specifications differ from those initially provided.

1.3 Acceptance of Terms

By engaging our services, requesting a quotation, or allowing us to handle your cargo, you accept these Terms and agree to be bound by them.

2. Customer Responsibilities

2.1 Cargo Information

Customers must provide accurate and complete information about their cargo including but not limited to: weight, dimensions, value, contents, special handling requirements, and any hazardous materials.

2.2 Packaging

Customers are responsible for proper packaging and securing of goods. HA Goods is not liable for damages resulting from inadequate packaging or failure to secure cargo properly.

2.3 Documentation

Customers must provide all necessary documentation including permits, licenses, customs declarations, and any other documents required for transport.

2.4 Payment

Payment terms are as specified in individual Service Agreements. Unless otherwise agreed, payment is due within 30 days of invoice date. Late payments may incur additional charges.

3. Liability and Insurance

3.1 Our Liability

HA Goods' liability is limited to the declared value of the goods or the actual value, whichever is less. Our maximum liability shall not exceed PKR 1,000,000 per shipment unless higher coverage is specifically purchased.

3.2 Insurance Coverage

All shipments include basic cargo insurance. Additional insurance coverage can be purchased at the time of booking. Insurance claims must be filed within 30 days of delivery or expected delivery date.

3.3 Excluded Liabilities

HA Goods is not liable for delays caused by weather conditions, government regulations, customs delays, natural disasters, or other circumstances beyond our reasonable control.

4. Delivery Terms

4.1 Delivery Timelines

Delivery timelines are estimates based on normal operating conditions. While we strive for on-time delivery, timelines are not guaranteed and delays may occur due to factors beyond our control.

4.2 Delivery Confirmation

Goods are considered delivered when handed over to the consignee or their authorized representative. Proof of delivery will be obtained and maintained by HA Goods.

4.3 Undeliverable Cargo

If cargo cannot be delivered due to incorrect addresses, absence of consignee, or refusal to accept delivery, storage charges will apply after 48 hours. Cargo may be disposed of after 30 days at the customer's expense.

5. Prohibited Items

5.1 Restricted Items

HA Goods does not transport illegal substances, explosives, firearms, perishable items without proper arrangements, hazardous materials without proper documentation, or items prohibited by law.

5.2 Special Cargo

Some items require special handling and documentation. Customers must declare all special cargo and obtain proper permits and documentation before transport.

6. Dispute Resolution

6.1 Claims Process

Any claims for loss, damage, or delay must be reported within 7 days of delivery or expected delivery date. Claims must be submitted in writing with supporting documentation.

6.2 Governing Law

These Terms are governed by the laws of Pakistan. Any disputes will be resolved through arbitration in Karachi, Pakistan, in accordance with Pakistani arbitration laws.

7. Termination

7.1 Service Termination

Either party may terminate services with written notice. HA Goods reserves the right to refuse service or terminate agreements for breach of these Terms, non-payment, or safety concerns.

8. Modifications to Terms

8.1 Updates

HA Goods reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and take effect immediately. Continued use of our services constitutes acceptance of modified Terms.
